BTW Solicitors are a firm of specialist Personal Injury and Insurance claim Solicitors based at 228 Hoylake Road, Moreton, Wirral, CH46 6AD.
This policy explains when and why we collect personal information about you, how this information is used, when it may be disclosed to others and how it is kept secure. We are required to continuously and comprehensively monitor our data processing activities, identify security risks and vulnerabilities and take appropriate steps to address them.
How and why we collect your personal information
When you use our website or interact with us online, by phone or email, you may be asked for personal details which may include the following: your name, address, contact details, email address, date of birth, national insurance number, employment details, medical details including your medical records and bank details.
When you visit the firm’s website, we do have the ability to automatically collect information about your visit, such as your browser type, your IP address and the website from which you came. This information is solely collected in connection with the legal services we provide for you to include your initial enquiry.
How we use your personal information
We only use your personal data when the law allow us to for the provision of legal services. Your information will never be disclosed for marketing purposes. This firm will not transfer your personal data to any third countries and/or outside of the United Kingdom. Information will be shared only were absolutely necessary and while carrying out the legal work that we do for you, e.g. instructing medical experts and other expert witnesses, Barristers and other professional advisors and service providers as well as the potential Defendant in a legal claim. However, those third parties are still bound to respect the security of your personal data and to treat it in accordance with the law and we will never allow third party service providers to use your personal data for their own purposes and we only permit them to process your personal data for specified purposes in accordance with our instructions.
Storage of personal data
Your personal data will be held on our computer system which is managed and maintained by Parity ICT and Rightclick Solutions and we take appropriate technical and organizational measures to ensure an adequate level of security to try to prevent unauthorised access of the personal data we hold. If we print personal data, this will be in the possession and control of our staff or those instructed by us at all times and will be securely disposed of in accordance with our data archiving and retention policy.
While we try to ensure confidential and sensitive personal data is transferred in a secure way, unfortunately the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal information at all times, we cannot guarantee the security of your information transmitted electronically and any transmission is at your own risk. We cannot accept responsibility for the ultimate security of emailed or faxed correspondence or documents once they are out of our control.
How long we keep your personal information
We keep personal information only for as long as necessary to ensure we can deliver our services and in line with our retention and disposal policy which reflects legal requirements and regulatory and compliance functions, e.g. at the conclusion of a legal claim, regulatory rules require us to store your file for at least 6 years. For children, this period of 6 years starts from their 18th birthday. As soon as any legal or regulatory period has passed, all of your data will be securely destroyed.
Under Data Protection laws, you have the legal right to know what personal information we hold about you and how that data was obtained. If you wish to access this information, you can send a Subject Access Request (SAR) in writing to Mr Adrian Wynne at BTW Solicitors, 228 Hoylake Road, Moreton, Wirral, CH46 6AD. Subject Access Requests will be dealt with within 30 days of receiving a written request. There is no charge for a SAR.
The accuracy of your information is important to us and if the information we hold is inaccurate or out of date then you can ask for this to be rectified and this will be dealt with within 14 days of receipt of the request.
You also have the right to request that we erase your personal data. Any such request will be dealt with within 30 days of receiving a written request. However, we should inform you that we may not always be able to comply fully with such a request for specific legal reasons which will be notified to you, if applicable, at the time of any such request.
Your right to complain to the Information Commissioner’s Office (ICO)
We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so. Updates to this policy
We may review this policy from time to time and any changes will be notified by posting an updated version on our website. We recommend you regularly check for changes and review this policy whenever you visit our website. If you do not agree with any aspect of the updated policy you must immediately notify us and cease using our services.
